Buckley Landscape Supplies Terms and Conditions
A customer is any individual who has made a contract with the company for any services or the supply of products.
Delivery can be through either the delivery by the company the delivery made by a haulier employed by the company directly or indirectly.
These terms and conditions are only able to be modified through a variation in writing signed by a director of the company.
Any purchase made through an online order will be taken as the agreement to these terms and conditions of sale.
Quality
It is Buckley’s aim to supply materials and products of the best quality. However, if for some reason the customer is unhappy with the quality of goods received then they should email info@buckleylandscapesupplies.com to report this within seven working days of receiving the goods.
The Company regret that they will be unable to replace goods which have not been reported as inadequate within this time frame. The Company is also unable to replace goods which have been used or removed from the packaging supplied in.
In most cases the goods which require replacing will need to be readily available in the original packaging and at the same point of delivery to allow for successful collection.
Buckley Landscape Supplies will not be held liable for any contamination of product discovered & reported more than 12 hours after delivery.
Buckley Landscape Supplies will not accept legal liability in respect of loss of or damage to any product supplied or for the costs of recall or removal repair alteration replacement or reinstatement of such product supplied or any part thereof caused by any defect therein.
If you have ordered one of our organic topsoil or compost mixes please remember - we do not chemically treat our products for weeds. Weeds thrive in warm, wet weather and especially in very fertile soils and composts like our own. Although every care is taken to remove weeds during our screening process we can not guarantee that weed seeds are not present in the soil or compost that you receive. To keep your topsoil organic we suggest pulling up common weeds, when and if they appear, instead of using chemical weed-killers.
Buckley Landscape Supplies also offer a range of budget products; such as 25mm screened soil, which are still of reasonable quality but will definitely contain stone, rubble or other debris. If you are concerned about the quality of any of the products you are ordering then please opt for those which are tested to the relevant British Standard, such as the bark and Topsoil.
Supplying of Products
All products sold under the express understanding of the following:
The company is liable up to the value of the supplied and sold goods only.
No condition or warranty is given or implied by law, custom, usage or otherwise as to the quality or fitness for any purpose of the goods sold by the company, unless specified in writing by the company
All Customers contracting must understand the company may supply goods through a third-party supplier. The substituted goods will be to the equal quality to what is supplied by Buckley Landscape Supplies.
The customer completely understands turf is an ever changing product as it is a growing crop.
The customer completely understands turf is perishable and must be laid on ready prepared topsoil.
The customer completely understands the turf must be rolled out and laid correctly within a maximum of two hours and should be watered adequately.
All topsoil and products similar are measured when packed and settlement will occur due to the behaviour of the natural product.
The customer is aware that topsoil is measured by a certified loading bucket and not by the dimensions of the bag it is delivered in.
The customer is aware that the stated weights and measures of bulk bags are approximate only.
The company requires a complaint to be made In writing by the customer withing 48 hours of collection or the delivery of goods.
Complaints can be sent to the registered address of the company or via email to info@buckleylandscapesupplies.com.
Delivery
The company will do all they can to deliver products ordered on the requested date, however, if a delivery is unable to be made then no liability will fall to the company, whether in damages or otherwise, for delay of whole or any parts of the goods ordered arising from any possible cause.
Delivery by the company is conditional upon access free from obstruction and good roads being available to the vehicles of the company to the point of delivery.
The company will not accept any liability for any damages to any property caused during delivery where the customer has instructed the driver or have made a request for goods to be delivered anywhere but the kerbside.
In cases where damages have been caused by a third party employed by Buckley Landscape supplies, the customer will be provided with the insurance and contact details of the third party for any claims for damages or insurance claims direct with the supplies.
The customer is completely aware that the company can only guarantee delivery to a kerb or roadside and that they are happy for goods to be left in this manner.
Customers are aware that in some parts of the UK it is necessary to obtain a permit for goods to be delivered to the kerb or roadside.
If the customer requests delivery to somewhere other than the kerb or roadside. They are aware that it may not always be possible and therefore must take the delivery to kerb or roadside in these situations.
If the delivery to the customers specified point is possible, then it is the customers responsibility to ensure all access routes and areas the delivery vehicle must travel can withstand the weight of a vehicle of 18 tonnes or more.
The Delivery vehicles do not drive across fields or unmade roads.
The cost of a vehicle being held up in this or a similar manner will be charged to the customer at a rate of £40 + VAT per hour.
If a customer insists on any vehicle to leave the public highway and enter their property or premises of delivery then the customer accepts liability for any damages caused to the property, vehicle or other.
If the company or its agent cannot gain access to the delivery address then additional costs may be incurred and shall ultimately fall to the customer
